A coroner has issued a formal warning that more patients could die at an east London mental health facility unless serious staffing failures are urgently corrected, following the killing of a 34-year-old man by a fellow patient earlier this year.

Hugo Flint Cahan was strangled by 22-year-old Rolando Torres-Pena at the Newham Mental Health Centre, a facility that provides care for acutely mentally ill men, in January 2023. The senior coroner for east London, Graeme Irvine, has now sent a Prevention of Future Deaths report to the East London NHS Foundation Trust (ELFT) and NHS England, outlining 14 separate areas of concern that he believes require immediate attention.

The coroner's intervention follows a six-day inquest held in September, during which Irvine concluded that neglect had more than trivially contributed to Cahan's death. The inquest heard distressing evidence about the conditions on the ward on the night of the killing.

Staff on duty that night were found to have been asleep while working and had been using their mobile phones for extended periods, rather than monitoring patients. The coroner's report highlights a failure to carry out timely and thorough observations of patients, followed by the deliberate falsification of records. According to the document, staff falsified these records "in the safe knowledge that staff on duty would not report or escalate the deception."

The report further reveals that there were delays in beginning CPR when Cahan was discovered, potentially reducing his chances of survival. Additionally, staff misled police officers about what the patients had been doing on the night of the incident. The coroner also found evidence that staff colluded with one another to take unauthorised breaks lasting two hours at a time.

Torres-Pena, who pleaded guilty to manslaughter by diminished responsibility in 2023, was given a hospital order with no time limit. This means he will remain detained in a secure mental health facility indefinitely, subject to periodic review.

In a particularly damning section of the report, the coroner noted that many of the failings identified in this inquest had previously been raised during a separate inquest he conducted in 2021. "The findings in this inquest are strikingly similar to the findings of an inquest before this court in 2021," the report states. "Remedial measures reported in that case do not appear to have been implemented effectively by the trust."

This repetition of failures across multiple investigations raises serious questions about the Trust's ability to implement and sustain meaningful reforms. The coroner's decision to issue a Prevention of Future Deaths report—a legal mechanism designed to compel organisations to address systemic risks—reflects the gravity of his concerns.

James Cahan, the family solicitor and Hugo's cousin, spoke of the family's profound distress at the findings. "Findings of dishonesty on this scale are extraordinarily rare in a coronial investigation," he said. "The public are entitled to expect a clear explanation of how this was allowed to happen and what is being done to ensure it never happens again."

The coroner also directed criticism at NHS England for failing to make independently produced patient safety reports publicly available. The inquest heard that a report commissioned after Cahan's death had already identified some of the serious failings that the coroner subsequently investigated. This suggests that lessons could have been learned earlier had the findings been shared more widely.

An NHS spokesperson responded to this criticism by stating that "patient safety incident investigations should always be published, with any necessary redactions to protect patients' identities, while making sure the lessons and learning are clear."

In a statement, Dr David Bridle, Chief Medical Officer for ELFT, apologised to Cahan's family for the failings in his care. He confirmed that one member of staff who was on duty on the night of the incident has been dismissed, while four others are now under investigation by the Trust. "We will ensure the learning from the coroner's findings informs our continuing work to strengthen patient safety and care," Dr Bridle said.

The Trust has acknowledged that the failings identified were "wholly unacceptable" and says it has undertaken a "significant programme of work" to improve inpatient services. However, the coroner's report makes clear that substantial concerns remain about whether these improvements will be sufficient to prevent future tragedies.

The case has raised broader questions about the adequacy of staffing levels and oversight at mental health facilities across England. The combination of staff sleeping on duty, falsifying observation records, and colluding to take extended unauthorised breaks suggests a culture in which basic standards of patient care were not being met or enforced.

The coroner's report also highlights the importance of transparency in healthcare investigations. The failure to publish the earlier report into patient safety at the Trust meant that the public and other healthcare providers were unable to learn from its findings in a timely manner.

ELFT and NHS England have until 19 November to respond to the coroner's Prevention of Future Deaths report. Their responses will set out what actions they intend to take to address the specific concerns raised and prevent similar deaths from occurring in the future. The families of patients currently receiving care at the Newham Mental Health Centre, as well as those across the Trust's services, will be watching closely to see whether these commitments translate into meaningful change.
